Residents' issues brought up on the Superior CAC Listserv

To answer residents' questions on the topics below:

Eldorado school site (referred to as Richmond 11): 2014, the site will be legally deeded over to the Town. The Town can acquire it before 2014, but would need to formally legalize that action. The Town may use the property as public use until 2014. BVSD is not the steward of the land, they only hold an option to build by 2014. The Town is the steward and maintains the land today and in the future.

Richmond American Homes: Had 90 days to submit a development plan. The 90 days came and went with no plan submitted by Richmond causing the land swap negotiation to be null and void.

Richmond 15 parcel: This parcel at the NE corner of McCaslin and Coalton is legally owned by Richmond American Homes.

As far as the issue with the State:
No fine has occurred toward the Town unless all issues are not cleared per the State's requirements by their deadlines. No hazardous waste has been illegally deposited anywhere other than a proper land fill. With that, the state has found improper storage of solid waste (none hazardous) that one could liken to residential backyard debris that hasn't been formally disposed from lack of time and resources to do such. I know that if the State came to my back yard, I would most certainly get a warning to comply (nothing hazardous but extra wood, extra edging material, extra rock pile, etc) . However, with businesses and government facilities there is no leniency. I don't condone debris sitting around per say but do consider this an opportunity to implement stricter guidelines for the Town. There is absolutely no proof that hazardous waste was used as landfill anywhere in Town and until definitive proof comes forward, I can't assume any wrongdoing on any one's part (Town or individual).
